By placing an order with us, whether online via our enquiry form, via telephone, or WhatsApp, you automatically agree to these terms. If you disagree with any part of these terms and conditions, please do not use our services.

1.2 These Terms serve as a legally binding agreement between you ("the Customer" or "you") and CDB-Topsoil ("us", "we", or "our"), governing your use of our website and purchase of products and services.
2. Orders
2.1 By placing an order through our website, telephone, or WhatsApp, you warrant that you are legally capable of entering into binding contracts.
2.2 An order shall only be deemed accepted by us when you receive a confirmation email or communication from us acknowledging the order. Until that time, we reserve the right to refuse your order.
3. Prices and Payment
3.1 The prices for goods shall be as quoted on our website, except in cases of obvious error. We reserve the right to change prices at any time without notice.
3.2 Payment for all goods must be by credit or debit card, PayPal, or any other payment method as specified on our website. We will charge your chosen payment method upon order confirmation.
3.3 We accept payment via cash or bank transfer upon delivery of goods.
3.4 All orders are subject to a delivery charge.
4. Delivery
4.1 Delivery charges and estimated timescales are specified in our Delivery Policy and when you make an order. We make every effort to deliver goods within the estimated timescales, however, delays are occasionally inevitable due to unforeseen factors.

4.6If you are not available to receive the delivery as scheduled, please inform us in advance to arrange an alternative delivery date or specific instructions for leaving the goods in a secure location.
4.7CDB-Topsoil cannot be held responsible for any loss or damage to goods left unattended at your request.
5. Returns and Refunds
5.1 Products must be returned to us within 14 days of delivery for a full refund of the product cost, excluding the initial delivery fee. Returns must be made at the customer's expense. If unable to return the product, where possible and entirely at our discretion, CDB-Topsoil can collect the product for a collection fee that is determined by us. This is dependent on location, size of order and a reprocessing charge.
5.2 Due to the nature of our Loose products, once they are tipped they are unable to be returned. We would therefore recommend the customer to be present upon delivery.
5.3 CDB-Topsoil must be made aware of the return within 14 days of delivery
5.4 To ensure a smooth return process, it is essential that the product remains unused and retains its original condition, just as it was upon delivery. This includes maintaining the product in its original packaging, free from any damage or alterations. CDB-Topsoil reserves the right to refuse a return if the product is found to have been used, altered, or is no longer in the condition it was delivered in. Instances rendering a product ineligible for return include, but are not limited to, exposure to moisture rendering it unsellable, or any physical changes that compromise the product's integrity.

6. Customer Responsibility
6.1 It is the customer's responsibility to ensure that the delivery location is accessible and suitable for the receipt of goods. This includes, but is not limited to, ensuring there is no restricted access, that the unloading area is even and clear, that there is no blocked access, and that there are no low-hanging trees or other obstacles that could hinder the delivery process. Any costs incurred due to inaccessible delivery sites or the need for additional delivery attempts resulting from such conditions will be the responsibility of the customer. Specifically, the customer will be liable to pay for the delivery fee in the event of a failed delivery attributable to the customer's failure to provide suitable delivery conditions.

7. Cancellation and Amendments
7.1 CDB-Topsoil understands that plans can change, and we strive to accommodate our customers' needs while managing our inventory and delivery schedules efficiently.
7.1.1 Your order may be cancelled without penalty up until 24 hours before the scheduled delivery date. To cancel your order, please contact us directly using the contact information provided on our website or in your order confirmation.
7.1.2 Cancellations made less than 24 hours before the scheduled delivery date will incur a 20% restocking charge. This fee compensates for the administrative costs, inventory allocation, and potential loss of sale associated with a late cancellation.
7.1.3 We understand that sometimes a scheduled delivery date may no longer be convenient. Therefore, we allow customers to amend their delivery date free of charge up to 3 times. This policy is designed to provide flexibility while ensuring that our delivery operations run smoothly and efficiently. Please notify us as soon as possible if you need to reschedule your delivery.
7.1.4 Should you need to amend your delivery date more than 3 times, we reserve the right to consider the order cancelled. At this point, the order will be subject to the 20% restocking charge as outlined in section 7.1.2.
8. Notification of Changes
8.1 In the event of a change to the scheduled delivery date, CDB-Topsoil will provide you with as much notice as possible. We understand the importance of planning and will make every effort to communicate changes promptly.
8.2 Notification of any changes to the delivery schedule will be made via the contact information provided by you at the time of order. Please ensure your contact details are current and accurate to facilitate effective communication.
